1. Introduction

Welcome to Anatch Media (“we,” “our,” or “us”). By accessing or using our website and services, you agree to comply with and be bound by the following Terms and Conditions. These terms apply to all clients, users, and visitors engaging with our digital marketing, SMS, and WhatsApp communication services.

2. Services

Anatch Media provides digital marketing solutions including, but not limited to, Bulk SMS Campaigns, WhatsApp Marketing, Social Media Management, Pay-Per-Click Advertising, Search Engine Optimization, and Automation Services.

• SMS and WhatsApp credits or packages purchased through Anatch Media are prepaid and non-refundable.

• Credits are valid for 3 months from the date of purchase. Any unused credits after this period will automatically expire and cannot be reactivated or refunded.

• All services are subject to availability and technical feasibility.

3. Compliance and Regulations

WhatsApp Marketing

• WhatsApp services are provided through Meta-approved Business Service Providers (BSPs).

• All users and campaigns must comply with Meta’s Commerce and Business Messaging Policies.

• Anatch Media will not be liable for message delivery failures or account suspensions resulting from violations of Meta’s policies.

SMS Campaigns

• SMS marketing is subject to the rules and regulations of the Telecom Regulatory Authority of India (TRAI).

• Clients are responsible for ensuring that message content complies with DLT (Distributed Ledger Technology) and other TRAI requirements.

• Non-compliant content or sender IDs may result in message rejections or penalties as per TRAI norms.

4. Payments and Invoicing

• All payments must be made in full and in advance unless otherwise stated in the invoice.

• For postpaid arrangements, payment is due within 30 days of the invoice date.

• Late payments may attract a 1.5% monthly interest on the outstanding balance.

• Services may be paused or terminated in case of non-payment.

• All payments are non-refundable once the service or campaign has commenced.

5. Cancellation and Refund Policy

• Cancellation requests must be made in writing before campaign setup or initiation.

• Once campaign execution begins, no refunds or cancellations will be processed.

• For prepaid credits, cancellations are not applicable after activation.

6. Content and Responsibility

• The client is solely responsible for the content, creative, and data shared for marketing campaigns.

• Anatch Media will not be held liable for any legal claims arising due to misleading, defamatory, or non-compliant content.

• All content must comply with applicable advertising laws, data privacy standards, and platform-specific guidelines.

7. Data Privacy

• Anatch Media ensures reasonable measures to protect client data and campaign information.

• We do not sell, rent, or disclose client data to third parties, except as required by law or necessary to provide services.

• Clients are responsible for obtaining necessary consent from their recipients before sending promotional messages.

8. Limitation of Liability

• Anatch Media shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services.

• We are not responsible for message delivery delays, failures, or inaccuracies due to third-party platforms, carrier networks, or regulatory restrictions.

• Our total liability, in any case, will not exceed the amount paid by the client for the respective service.

9. Intellectual Property

• All designs, strategies, and creative materials developed by Anatch Media remain our intellectual property unless otherwise agreed in writing.

• Upon full payment, the client receives limited rights to use the deliverables for their intended marketing purpose.

10. Modification of Terms

Anatch Media reserves the right to update, modify, or change these Terms and Conditions at any time without prior notice. Continued use of our website or services implies acceptance of the updated terms.

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts of Faridabad.
